Independent Bill Review (IBR) Process

What is Independent Bill Review (IBR)?

Under California Labor Code Section 4603.6, Independent Bill Review (IBR) provides medical providers with a quick, administrative path to resolve billing disputes with claims administrators. If a medical treatment or service bill is underpaid or denied after a Second Review, the provider can request an independent medical billing expert to determine the correct fee schedule reimbursement.

Step 1: Complete the Prerequisites (Second Review)

Before filing for IBR, statutory prerequisites must be met:

  • Submit Request for Second Review: You must first request a Second Review from the claims administrator within 90 days of receiving the initial Explanation of Review (EOR).
  • Receive Second Review EOR: The claims administrator must issue a final Explanation of Review following the second review request.
  • Threshold Requirement: IBR applies strictly to billing amount disputes under the Official Medical Fee Schedule (OMFS) or Medical-Legal Fee Schedule. It cannot resolve legal liability or threshold medical necessity issues.

Step 2: Submit the IBR Application

If the Second Review does not resolve the billing dispute, file an electronic IBR application through the state portal:

  1. File Online: Submit the application electronically via the DWC's official online IBR portal.
  2. Strict 30-Day Deadline: The IBR application must be filed within 30 calendar days from the date of service of the Second Review Explanation of Review.
  3. Pay Filing Fee: A required administrative filing fee must be paid by the provider at the time of submission (if the IBR decision is in the provider's favor, the claims administrator must reimburse this fee).
  4. Consolidation Option: Related billing disputes (e.g., multiple dates of service for the same patient or same procedure) can often be consolidated into a single IBR application.

Step 3: Review Timeline & Process

Once the application is submitted, the independent review organization processes the request according to strict timelines:

Stage Process Description Timeline
1. Eligibility Review The DWC checks the application for completeness, proper fee payment, and eligibility. ~15 Days from Receipt
2. Documentation Submission The provider and claims administrator submit supporting billings, chart notes, and EORs. 15 Days from Notice
3. Expert Evaluation An independent billing analyst evaluates the medical codes, modifiers, and OMFS/Medical-Legal rules. 30 Days from Assignment
4. Final Determination The Administrative Director adopts the IBR decision and issues a final binding order. Final Order

Step 4: Final Ruling & Fee Reimbursement

Understanding the outcomes of a final IBR ruling:

  • Binding Order: The IBR decision issued by the Administrative Director is final and legally binding on both parties.
  • Provider Win: If additional reimbursement is awarded, the claims administrator must pay the additional amount plus reimburse the provider's IBR filing fee within 45 days.
  • Claims Administrator Win: If no additional money is found due, the claims administrator is not required to pay more, and the filing fee is retained by the IBR organization.
